Terms of use

General

Stuklex is the Radiation and Nuclear Safety Authority's public and free-of-charge online service for legal documents. The content of Stuklex is produced and maintained by Edita Lakitieto Oy (hereinafter “Edita”) and the Radiation and Nuclear Safety Authority (hereinafter “STUK”). Both STUK and Edita can later be referred to as service providers.

Stuklex presents all pages as they are. The manner in which the pages are displayed depends on the settings of the viewer's web browser.

Stuklex does not cover legal advice and content interpretation regarding the texts contained by the service.

The different language versions of Stuklex (Finnish, Swedish and English) are not identical. The Finnish-language version features the most content.

Hardware requirements

Stuklex is compatible with the most commonly used browsers in Finland.

The service requires the browser's JavaScript support to be on and cookies to be allowed. Each user is responsible for obtaining and maintaining the hardware, software and data communication connections required to use Stuklex, and other technical devices and related costs. In order to ensure the user's data security and the general functionality of Stuklex, we recommend using the latest browser versions.

Copyrights and related rights

A portion of Stuklex content is copyright free (Copyright Act 404/1961, Section 9).

Individual documents in the Stuklex databases are subject to the normal copyright restrictions, with the exceptions specified in Section 9 of the Copyright Act (404/1961) The documents may be quoted in accordance with proper usage to the extent necessary for the purpose (Copyright Act, Section 22). When quoting the material, the source, i.e. Stuklex, must be indicated alongside other necessary reference information (Copyright Act, Section 11(2)).

However, the service providers have the exclusive right to control the entirety of the Stuklex databases or, in qualitative or quantitative terms, substantial part thereof by making copies of it and by making it available to the public (Copyright Act, Section 49(1)(2)). Therefore, an entire database or substantial part of it may not be copied and published as part of another product or service. Linking documents to serve as part of another website in a manner that violates the principles of proper usage in terms of extent, method of presentation or other aspects is also prohibited.

Furthermore, some Stuklex databases contain copyright-protected material. Among the databases that include documents produced by Edita, the copyright protection applies to those containing up-to-date domestic legislation, EU legislation and international agreements. Most of the text documents in these databases are aggregates, wherein Edita has supplemented the original domestic statutes, EU statutes and international agreements with all of the amendments made to them and, for example, the relevant editor's notes regarding the entry into force of amended statutes and the commencement provisions of the amending acts. Edita has the exclusive right to control the full content of these aggregates or, in qualitative or quantitative terms, a substantial part thereof by making copies of it and by making it available to the public (Copyright Act, Section 49(1)(2)). Therefore, documents copied from the aforementioned databases may not be used to produce new databases or other publications. The documents may be quoted in accordance with proper usage to the extent necessary for the purpose.

User liability

The user shall be liable for any such use of Stuklex and the documents contained therein that violates the law, official regulations or the principles of proper usage, and for any damage caused to third parties. Provisions on the liability for damages in copyright related matters are laid down in Chapter 7 of the Copyright Act. Stipulations on criminal liability in this context are set forth in Chapter 7 of the Copyright Act and Chapter 49 of the Criminal Code (39/1889).

Service provider liability

The service providers cannot be held liable by users or third parties for any possible errors or deficiencies in Stuklex, for any direct or indirect damage caused by the information in Stuklex or by the interpretation of this information. Furthermore, the service providers cannot be held liable for the suitability of Stuklex for any particular purpose. The service providers cannot be held liable for any possible interruptions in Stuklex due to maintenance, technical failures or other similar reasons, or for any interruptions in data communication connections or the Internet in general.

Stuklex contains links to websites other than those maintained by STUK. STUK does not control such sites and is in no way liable for their content or legality.

Changing the functionalities of Stuklex

The service providers are entitled to change the content and functionalities of Stuklex and these terms of use for the purpose of developing Stuklex or for any other necessary reason. Furthermore, STUK may at any time discontinue the Stuklex service in part or in full, or prevent a user from accessing it.

Dispute resolution

Disputes arising from the use of Stuklex shall primarily be resolved through negotiations between the parties. If the negotiations fail to lead to an understanding, the dispute shall be resolved in the District Court of Helsinki in compliance with Finnish legislation. Copyright matters shall be resolved in The Market Court.
